Atty. Israelito Torreon, Dean of Jose Maria College’s Law Department offers his advice come elections after allegations of missing votes appear on social media.
TO ALL DUTERTARDS:
If in case what is posted below happens to you on election day, what should you do?
1.) Relax! Dont blame the Board of Election Inspectors because i am pretty sure that they are as dumbfounded as you are. Instead, calmly approach the Chairman of the Board of Election Inspectors and inform him/her that your vote for Duterte does not tally with what appears on the screen of the Voting Counting Machine (VCM) and request that your incident or “protest” be duly recorded in the Minutes of Voting;
2.) Request that you sign the receipt of the votes given to you by the Board of Election Inspector for identification and authentication and request that this receipt be placed instead in the Minutes of Voting instead of the intended receptacle for the said receipts;
3.) Request a copy of the minutes of the voting containing your protest duly signed by the Board of Election Inspectors;
4.) Ensure that you have a photograph inside or within the vicinity of the precinct to validate your presence in the said precinct;
5.) Report the incident to the nearest police station or to the nearest legal team for recording purposes;
6.) Post it on facebook for additional recording purposes.
CAVEAT: I am not actively involved in the Duterte campaign and this is just my one-cent worth legal opinion on how to protect your votes this coming May 9 elections. This opinion maybe improved further after a thorough research because this is just a knee-jerk reaction from the various posts or reports i have read online yet no one has provided at least a sensible legal remedy as to what to do if in case your vote is not counted properly. As a matter of fact, im composing this while im in my van after i accompanied a friend to Davao City airport. This is also done to force a discussion vis-a-vis legal remedies on various probable incidents of cheating that will surely happen before, during and after the elections.
I have handled so many election cases in the past and i am genuinely afraid that something “big” may happen during or after the elections. I even had one case in the past where almost all residents in one barangay executed an affidavit attesting that they voted for a certain Gubernatorial candidate yet the latter had a ZERO vote in that barangay. Hence, im urging everyone not to fall too much on the “diversionary” issue being peddled by the most expensive Senator of the land (he is indeed the most expensive since he incurred the greatest expenses among all Senators) because that is clearly “rubbish” and intended not only to smear the impeccable reputation of Mayor Rody Duterte but also to divert our attention from the more important job, that is, preparation on how to ensure that our votes are clearly counted and the results efficiently transmitted to the National Board of Canvassers. THIS IS THE MOST URGENT CALL OF THE MOMENT – EDUCATE OURSELVES AND PREPARE HOW CAN WE ENSURE THAT OUR VOTES ARE PROPERLY COUNTED AND TRANSMITTED!
LET US ALL PROTECT THE FUTURE OF OUR CHILDREN! VOTE PROPERLY AND WISELY THEN ENSURE THAT OUR VOTES ARE PROTECTED, PROPERLY COUNTED AND TRANSMITTED!
FOR OUR FUTURE, PLEASE VOTE FOR DUTERTE FOR PRESIDENT AND IN COMPLIANCE WITH THE REQUEST OF OUR PRESIDENT, LET US VOTE FOR CAYETANO FOR VICE PRESIDENT!
